1. Agreement to Terms
By accessing or using Bizzzy ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform. The materials contained in this platform are protected by applicable copyright and trademark law.
2. Description of Service
Bizzzy is a video-first marketplace that connects creators ("Makers") with local communities ("Takers"). The Platform allows users to showcase their skills, find opportunities, and book services through video-first storytelling. Users can switch between Maker and Taker modes to either offer or seek services.
3. User Accounts
Registration: You must create an account to use certain features of the Platform. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
Account Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Eligibility: You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years of age.
4. User Conduct
You agree not to:
- •Use the Platform for any illegal purpose or in violation of any laws
- •Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- •Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
- •Interfere with or disrupt the Platform or servers or networks connected to the Platform
- •Use any automated system, including "robots," "spiders," or "scrapers" to access the Platform
- •Collect or store personal data about other users without their express permission
5. Content
User Content: You retain all rights to the content you post on the Platform. By posting content, you grant Bizzzy a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content on the Platform.
Content Standards: All content must comply with our community guidelines. We reserve the right to remove any content that violates these Terms or is otherwise objectionable.
Copyright: We respect intellectual property rights. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us at copyright@bizzzy.app.
6. Payments and Fees
Service Fees: Bizzzy charges a service fee for transactions completed through the Platform. The fee structure is clearly displayed before you complete a transaction.
Payment Processing: Payments are processed through third-party payment processors. You agree to comply with the terms and conditions of our payment processors.
Refunds: Refund policies are determined by individual creators and are displayed on their profiles. Bizzzy facilitates refunds but is not responsible for disputes between users.
7. Maker and Taker Responsibilities
Makers: If you offer services as a Maker, you agree to provide services as described, maintain professional standards, and fulfill all commitments made to Takers. You are responsible for the quality of your work and any taxes or licenses required for your business.
Takers: If you book services as a Taker, you agree to provide accurate requirements, respond promptly to Maker communications, and complete payment as agreed.
8. Disclaimers and Limitations of Liability
Platform "As Is": The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Bizzzy does not warrant that the Platform will be uninterrupted, secure, or error-free.
User Interactions: Bizzzy is not a party to any agreement between Makers and Takers. We are not responsible for the quality, safety, legality, or any other aspect of services provided by users.
Limitation of Liability: To the maximum extent permitted by law, Bizzzy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform.
9. Indemnification
You agree to indemnify, defend, and hold harmless Bizzzy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another party.
10. Termination
We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
11. Dispute Resolution
Informal Resolution: We encourage you to contact us first to seek informal resolution of any disputes.
Arbitration: Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with applicable arbitration rules, rather than in court.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bizzzy operates, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Platform after those revisions become effective, you agree to be bound by the revised terms.
